If you are a customer of the Site, EAZY SMART SRL will process your personal data such as your name and surname, phone number, email address, billing address, delivery address, data regarding how you use the Site, for example, your behavior/preferences/habits within EAZY SMART SRL, as well as any other categories of data that you provide directly in the context of creating a user account, placing an order through the Site, or in any other way resulting from the use of the Site.

If you use your Facebook or Google account to create a user account on the Site, EAZY SMART SRL will process the following public profile data displayed by the respective applications: username, email address.

If you choose to create a user account only before finalizing the order of a product available on the Site, your email address will be requested based on which an account will be automatically created. If you do not finalize the order, the email address and other provided data will not be stored by EAZY SMART SRL, and the created account will be automatically deleted.

II.2. If you are a visitor to the Site, EAZY SMART SRL will process the personal data you provide directly in the context of using the Site, such as the data you provide in the contact/questions/complaints section, to the extent that you contact us in this way.

  • to carry out the contractual relationship between you and EAZY SMART SRL, namely to take, validate, ship and invoice the order placed on the Site, inform you about the order status, organize product returns, etc.

Providing your data for this purpose is voluntary. Refusal to provide data for this purpose will have no negative consequences for you.

III.2. If you are a visitor to the Site, EAZY SMART SRL processes your personal data as follows:

  • for marketing activities, namely the transmission via distance communication means (email, sms) of commercial communications regarding the products and services offered by EAZY SMART SRL through the Site.

IV. Duration of Data Processing

As a principle, EAZY SMART SRL will process your personal data for as long as it is necessary to achieve the processing purposes mentioned above.

If you are a customer, we will process your data throughout the contractual relationship and afterwards in accordance with the legal obligations incumbent on EAZY SMART SRL (e.g., for financial-accounting documents, the legally required retention period is 10 years from the end of the financial year during which they were issued).

If you are a customer and you choose to delete your user account by email to hello@giaz.devdanco.com, EAZY SMART SRL will interpret this action as your decision to unsubscribe from receiving commercial communications about products and services offered through the Site. In this regard, if you choose to delete your user account, we will no longer send you such emails and/or SMS. However, please note that deleting the account will not automatically result in the deletion of your personal data. If you no longer wish your personal data to be processed or if you want your data to be deleted, you may exercise your rights detailed in Section VII below. If you request the deletion of your account, but the account has at least one active order, the request for deletion will be registered only after the delivery and completion of the last active order.

If you withdraw your consent for data processing for marketing purposes, EAZY SMART SRL will cease processing your personal data for this purpose, without affecting the processing carried out by EAZY SMART SRL based on the consent provided by you before its withdrawal.

V. Disclosure of Personal Data

To fulfill the processing purposes, EAZY SMART SRL may disclose your data to partners, third parties, or entities that support EAZY SMART SRL in carrying out its activities through the Site (e.g., courier companies, IT service providers), or to public authorities, in the following exemplary cases:

  • for Site administration;
  • in situations where this communication is necessary for awarding prizes or other benefits obtained as a result of your participation in various promotional campaigns organized by EAZY SMART SRL through the Site;
  • for maintaining, personalizing, and improving the Site and the services provided through it;
  • for data analysis, testing, and research, monitoring usage and activity trends, developing security features, and user authentication;
  • for sending commercial marketing communications, under the conditions and within the limits provided by law;

VI. Transfer of Personal Data

Personal data provided to EAZY SMART SRL will not be transferred outside of Romania.

VII. Your Rights

Under the conditions provided by the personal data protection legislation, as data subjects, you have the following rights:

  • right to be informed, i.e., the right to receive details about the processing activities carried out by EAZY SMART SRL, as described in this document;
  • right of access to data, i.e., the right to obtain confirmation from EAZY SMART SRL regarding the processing of personal data, as well as details about the processing such as how the data is processed, the purpose of the processing, the recipients or categories of recipients of the data, etc.;
  • right to rectification, i.e., the right to obtain without undue delay the correction by EAZY SMART SRL of inaccurate/unjustified personal data, as well as the completion of incomplete data; Rectification/completion will be communicated to each recipient to whom the data was disclosed, unless this proves impossible or involves disproportionate effort.
  • right to erasure of data, without undue delay, (“right to be forgotten”), if one of the following reasons applies:
    • they are no longer necessary for the purposes for which they were collected or processed;
    • consent is withdrawn and there is no other legal basis for the processing;
    • the data subject objects to the processing and there are no overriding legitimate grounds for the processing;
    • the personal data has been unlawfully processed;
    • the personal data must be erased for compliance with a legal obligation;
    • the personal data was collected in connection with the provision of information society services according to Union or national law applicable to the controller.

It is possible that, following a request to delete the data, EAZY SMART SRL will anonymize this data (thus depriving it of personal character) and continue processing for statistical purposes in these conditions;

  • right to restrict processing insofar as:
    • the accuracy of the data is contested by the person, for a period that allows verification of the data’s accuracy;
    • the processing is unlawful and the data subject opposes the erasure of the personal data, requesting instead the restriction of its use;
    • the controller no longer needs the personal data for the purpose of processing, but the data subject requires it for the establishment, exercise, or defense of legal claims; or
    • the data subject has objected to processing (other than direct marketing), for the period during which it is verified whether the legitimate grounds of the controller override those of the data subject.
  • right to data portability, i.e., (i) the right to receive personal data in a structured, commonly used, and machine-readable format, and (ii) the right for such data to be transmitted by EAZY SMART SRL to another data controller, provided that the legal conditions are met;
  • right to object – with regard to processing activities, may be exercised by sending a request according to the indications below:
    • at any time, for reasons related to the data subject’s particular situation, that data concerning them be processed under the legitimate interest of EAZY SMART SRL or under public interest, except where EAZY SMART SRL demonstrates compelling legitimate grounds that override the interests, rights, and freedoms of the data subject or for the establishment, exercise, or defense of legal claims;
    • at any time, free of charge and without any justification, that data concerning them be processed for direct marketing purposes.
  • right not to be subject to a fully automated individual decision, including profiling, which produces legal effects concerning the data subject or similarly significantly affects them;
  • right to address the National Authority for the Supervision of Personal Data Processing or competent courts, as you deem necessary.
